Jurista estadounidense. Hijo de inmigrantes judíos provenientes de Bohemia, asistió a la escuela en Kentucky y Alemania antes de graduarse en derecho en Harvard (1877). Como jurisconsulto en Boston (1877–1916), fue conocido como el "abogado del pueblo, por su defensa de la constitucionalidad de varias leyes estatales sobre salarios y jornada de trabajo, por su concepción de bancos de ahorro y planes de seguros de vida para los trabajadores y por sus esfuerzos para fortalecer las atribuciones del gobierno en materia de legislación antimonopolios. Su obra influyó en la aprobación, en 1914, de la ley Clayton antimonopolios y de la ley de la Comisión federal de comercio. También desarrolló lo que vino a denominarse como el "Informe Brandeis, sistema en el que se clasifican los datos económicos y sociológicos, los antecedentes históricos y la opinión del experto para apoyar la argumentación jurídica. Designado para la Corte Suprema de los
Estados Unidos de América (
1916), se distinguió por su aprecio a la
libertad de expresión. Muchos de sus votos de minoría, en los que a menudo estaba alineado con Oliver Wendell Holmes, Jr., fueron aceptados con posterioridad por la corte en la época del Nuevo Trato. Su nombramiento como primer juez judío fue vigorosamente resistido por algunos intereses empresariales y grupos antisemitas. Sirvió en la corte hasta 1939. La Universidad de Brandeis fue llamada así en su honor.
